Legionella Risk Assessment

Creative Green Energy are qualified risk assessors, their risk assessors holds the HABC Level 2 award in Legionella Awareness, are experienced with plumbing and heating systems and can offer an impartial legally robust service to property professionals who want to comply with current landlord and tenant regulations .

The legionella risk assessment is an assessment which is ignored by landlords, if a landlord is carrying out this check then other maintenance issues relating to water also will be more effectively managed.

The need for a legionella risk assessment is not new, it was always a duty under Section 3(2) of the Health and Safety at Work Act 1974 (HSWA) “It shall be the duty of every self-employed person to conduct his undertaking in such a way as to ensure, so far as is reasonably practicable, that he and other persons (not being his employees) who may be affected thereby are not thereby exposed to risks to their health or safety.”

Landlords, under Section 53 of HSWA are regarded as being self-employed and tenants fall into the class of “other persons (not being his employees). The Control of Substances Hazardous to Health Regulations 2002 (COSHH) provides a framework of actions to control the risk from a range of hazardous substances, including biological agents (eg Legionella) – to identify and assess the risk, and implement any necessary measures to control any risk – remedial action following a risk assessment and informing occupiers of their day-to-day duties in keeping the risk of contracting legionnaires disease to a minimum.

Legionnaires’ disease is a severe, often lethal, form of pneumonia. It’s caused by the bacterium Legionella pneumophila found in both potable (usually mains water) and nonpotable (usually water stored in a cold-water storage tank) water systems. The disease is often contracted by inhaling water vapour that has been colonised with the bacteria. A legionella risk assessment is the framework under which a person who has a duty of care for employees or tenants discharges this legal duty.

The law is clear that if you are a landlord and rent out your property (or even a room within your own home) then you have legal responsibilities   to ensure the health and safety of your tenant by keeping the property safe and free from health hazards.

Legionella risk assessments are for landlords, business owners and facility managers, and anyone within a premise who has a duty of care to an employee or tenant.

Legionella risk assessment requires un-restricted access to the property including areas where the cold-water storage tank and any pipework is located.
