Landlords Be LIONS

The present legal requirements landlords have to adhere to are complex and are more demanding of landlords, its not possible to describe in short terms what is required as it varies between: type of tenancies, type of property, licensing requirements through HMO and local authority requirements – its complex. The legislation that affects the role of having a tenant cuts across many areas of legislation, for your ease of reference read our last blog ‘Info Overload,’ https://www.creativegreenenergy.com/2018/01/11/information-overload-legislation-for-landlords-from-1730-to-present/ – which is a comprehensive list of the acts and laws since the 1700’s up to the present, with more expected through 2018.

Whether you be renting out a room to a friend or are a major player with a portfolio of properties – your duties of care to the tenant are the same; whether you are collecting rents from overseas clients at the most lucrative rates or you’re collecting just enough to cover last month’s expenses, yes I said last months – you still need to complete checks and keep records; whether you use and agent for some or all of your duties – you still need to know and make sure that all is done correctly on your behalf as ultimately you are responsible.

We think that LIONS is an ampt acronym that describes the culture that landlords need to adopt in order to assure continued success:

L: legislations and laws

I: implementation

O: organise

N: now, act to be compliant

S: secure the asset and protect the revenue

L: legislations and laws – be familiar with current requirements, and any revisions and changes that occur and might affect how you administrate the tenancy. Know which checks and assessments you need to do and the frequency

I: implementation, once clear on what the relevant bits of legislation are for a tenancy, have a strategy for dealing with and carrying out the duties of a landlord, know what you require of service providers to ensure that your duties are complied with, do not assume, check with them

O: organise, know where your information is, often information is collected or distributed in a variety of ways, via: email, messages, paper copies and verbally; know when checks are due for renewal, know the correct process for contractual obligations such as increasing rental fee, repairs by landlord or tenant – complete your duties in a timely manner by being organised

N: now, act to be compliant and don’t delay, except for omissions with the tenancy deposit process, most prescribed information requirements may be resolved relatively easily. Act today to bring a tenancy in line with recent legislation

S: secure the asset and protect the revenue, after all that is the main motivation when becoming a landlord in the private rental sector
