Deregulation in October 2015 must feel like walking on bananas, your bound to slip up at sometime!
That should not be the case, after all most landlords are savvy and know what they are doing.
So much changed with deregulation and its hard to keep track with what is mandatory against advisory or best practise. In this blog we are going to look at retaliatory evictions, as assessors and contractors I have visited many properties and it is clear that there are as many ‘bad’ tenants out there as there are ‘bad’ landlords, but we realise that it is now easier to appear to be a bad landlord because the situation became slanted in favour of tenants with de-regulation. You have to read the http://www.legislation.gov.uk/ukpga/2015/20/section/33/enacted, which is about Preventing retaliatory eviction, it is considered that when a tenant requests a repair then a neglectful landlord instead of setting about effecting a repair might give the tenant notice. Under the current rules there are quite specific requirements that a landlord should work to, see the attached link for advice to tenants provided by the National Homelessness Advice Service NHAS: http://www.nhas.org.uk/factsheets. If a landlord fails to carry out repairs in a timely fashion to absolute completion, then it could be considered harassment and compensation could be owed to a tenant following issues of disrepair, landlords could be barred from evicting a tenant under these circumstances for six months.
